1. Who We Are and What This Policy Covers
This Privacy Policy describes how Nite Creamery (“Nite Creamery,” “we,” “us,” or “our”) collects, uses, and shares personal information when you visit our website at https://franchise-nite-creamery.franchiseframeworks.com/ or otherwise interact with us through it (the “Site”).
The Site and the marketing and lead-management tools that support it are operated on our behalf by Franchise Frameworks (a trade name of Founders Frameworks Corp.), our technology provider. Franchise Frameworks acts as our service provider in operating the Site and may also use information collected through the Site for its own purposes as described in Section 4 and in its privacy notice at https://app.termly.io/policy-viewer/policy.html?policyUUID=1c1dda28-61d9-48a8-9bc6-af407b428b04.
2. Information We Collect
Information you provide. When you complete a form on the Site, we collect your name, email address, phone number, the state or province you are interested in, and information about your financial qualifications (such as your liquidity range).
Advertising and analytics data. When you visit the Site, we and our advertising and analytics partners automatically collect online identifiers (including cookie IDs, advertising IDs, and ad-click identifiers such as Google's gclid and Meta's fbclid), your IP address, device and browser information, the pages and ads you interact with, referring URLs, and inferences about your interests. We may also use your email address, in hashed form, to build advertising audiences with our advertising platforms.
Product analytics and session recordings. We and our product-analytics provider (PostHog) collect online identifiers, device and browser information, the pages and elements you interact with, and session recordings that replay your interactions with our pages so we can understand and improve usability. Form inputs are masked in these recordings.
Sensitive information. With your consent or as permitted by applicable law, we process limited categories of sensitive information: financial information (your qualification details) and, through our advertising partners, precise geolocation. We do not request other special categories of data.
3. How We Use Your Information
To respond and qualify. To respond to your inquiry, evaluate your interest in our franchise opportunity, and communicate with you.
Targeted advertising and remarketing. To serve advertisements about franchise opportunities to you on the Site and on other websites and platforms (including Google, Meta, and LinkedIn), to build and manage advertising audiences, and to measure advertising performance.
Matched audiences. To upload email addresses (in hashed form) to advertising platforms to create matched or “custom” audiences (Customer Match / Contact Targeting). Phone numbers collected through SMS opt-in are not used for this purpose.
Analytics and improvement. To understand how visitors use the Site, including through heatmaps and session recordings, so we can improve usability and performance. This is first-party analytics and is not used for advertising.
Legal and security. To comply with law, enforce our terms, and protect the security and integrity of the Site.
4. How We Share Your Information
Service providers. We share information with vendors that perform services for us, including Franchise Frameworks (our platform and lead-management provider) and our hosting, communications, and analytics providers. They may use the information only to provide services to us.
Advertising, analytics, and remarketing partners. We share online identifiers, device and activity data, and email addresses (in hashed form) with advertising and analytics providers, including Google, Meta, and LinkedIn, so they can measure advertising, serve ads to you across other sites and platforms (remarketing), and match you to audiences we build from uploaded email lists (Customer Match). We do not include phone numbers collected through SMS opt-in in these uploads. To the extent this is a “sale” or “sharing” under applicable US state law, you may opt out as described in Section 9.
Product analytics provider. We use PostHog as a product-analytics provider. PostHog processes usage and session-recording data as our service provider to help us improve the Site. It does not use this data for its own advertising and is not part of the matched-audience uploads above.
Franchise Frameworks network use. Franchise Frameworks may combine information collected through the Site with information from other landing pages it operates to build and serve advertising audiences across its network, and may include leads in its own marketing where permitted by law. These uses are described in the Franchise Frameworks privacy notice at https://app.termly.io/policy-viewer/policy.html?policyUUID=1c1dda28-61d9-48a8-9bc6-af407b428b04. Phone numbers and SMS opt-in data are excluded from these uses.
Legal, safety, and business transfers. We may disclose information to comply with law or legal process, to protect rights and safety, and in connection with a merger, financing, or sale of assets.
5. Cookies and Tracking Technologies
We use cookies and similar technologies (pixels, tags, and local storage). These include Google Analytics (GA4) for site measurement, and the Google Ads remarketing tag, the Meta Pixel, and the LinkedIn Insight Tag to measure advertising and show you ads about franchise opportunities across those platforms based on your activity on the Site.
We also use PostHog for product analytics and session replay, including heatmaps, to understand and improve how the Site is used; form inputs are masked in session recordings. Where required, these technologies are governed by your choices in the cookie/consent banner on the Site and by the opt-out rights in Section 9.
6. SMS / Mobile Messaging
Nite Creamery collects your phone number only when you voluntarily provide it through our website forms. We use it to communicate with you about our franchise opportunity, appointment reminders, and inquiries you initiate. Phone numbers and SMS opt-in data are not shared with third parties or affiliates for marketing or promotional purposes, and are not uploaded to advertising platforms. Message frequency varies and message and data rates may apply. You may opt out at any time by replying STOP, and reply HELP for help. 7. Your Marketing Choices
You can unsubscribe from marketing at any time by replying STOP or UNSUBSCRIBE to our SMS messages, using any unsubscribe link in our emails, or contacting us using the details in Section 12. You will then be removed from the relevant marketing lists. We may still send you service-related messages necessary to respond to your inquiry.
8. Do-Not-Track and Global Privacy Control
Because no common standard for Do-Not-Track has been finalized, we do not respond to generic Do-Not-Track browser signals. However, we recognize and honor the Global Privacy Control (GPC) signal as a valid request to opt out of the “sale” or “sharing” of personal information and of targeted advertising, where required by applicable US state law. When we detect a GPC signal from your browser or device, we treat it as an opt-out for that browser or device.
9. US State Privacy Rights
Depending on where you live, you may have rights to access, correct, delete, or obtain a copy of your personal information, to opt out of targeted advertising and the sale or sharing of personal information, and to not be discriminated against for exercising these rights.
We share personal information for targeted advertising, which may be considered “sharing” under California law and “targeted advertising” under other US state laws. This includes both automatic tracking technologies (pixels and tags) and uploading email addresses (in hashed form) to advertising platforms to build matched audiences. We do not sell personal information for monetary consideration.

Information shared for targeted advertising is limited to online identifiers, IP address, internet activity, interest inferences, and email addresses in hashed form. We do not share phone numbers collected through SMS opt-in, and we do not sell personal information for monetary consideration.
How to opt out. You may opt out of sharing and targeted advertising at any time using the “Do Not Sell or Share My Personal Information” link and the cookie/consent preferences on the Site, by emailing us at , or via the Global Privacy Control signal as described in Section 8. 10. Data Retention
We keep personal information for as long as needed to fulfill the purposes described in this policy, including to respond to your inquiry and pursue our franchise-marketing interests, and for as long as required to comply with our legal obligations. When no longer needed, we delete or de-identify it.
11. Data Security; Children; and Where Data Is Processed
We use reasonable administrative, technical, and physical safeguards to protect personal information, though no method of transmission or storage is completely secure. The Site is not directed to children, and we do not knowingly collect personal information from anyone under 18. Information we collect is processed in the United States; if you are located elsewhere, you understand your information will be processed there.
